These Terms of Service govern your booking of tours and rentals with Park City Is Rad (“we,” “us”), operated by Jabridgeco Inc.. By booking, you agree to these terms. Please read them with our Privacy Policy and SMS Policy.
Booking & payment
Payment is collected in full at the time of booking. Your reservation is confirmed only after payment is successfully processed and any required qualification is approved. Prices are shown per activity and may include per-person or flat (whole-boat) pricing.
Cancellations & refunds
- 72+ hours before your trip: cancel online for a full refund.
- Within 72 hours of your trip:online self-cancellation is closed. Refunds are handled case-by-case at the owner’s discretion, with the reasoning recorded.
- Weather or safety cancellations by us: you choose a full refund or a reschedule.
- Operational cancellations by us: full refund or priority reschedule.
- Trip cut short: if a trip is ended early due to circumstances, we may propose a partial refund. Any partial refund is applied only after you accept it.
Liability waiver
Our activities involve inherent risks. You will be required to read and sign a liability waiver before participating. The waiver you sign is recorded exactly as shown at signing. A parent or legal guardian must sign on behalf of any minor participant.
Boat rental qualifications
Bareboat (self-drive) rentals require an approved, unexpired on-water qualification; trailer-pickup rentals also require a towing qualification. Bookings cannot be confirmed until the required qualification(s) are approved.
Damage deposit
Renter authorizes Park City Is Rad to place a refundable damage deposit hold in the amount stated at checkout or in the rental confirmation. Unless otherwise stated, the standard damage deposit is $2,500 for renter-operated rentals and $1,500 for captain-operated or concierge rentals.
The damage deposit may be used to cover damage, loss, excessive cleaning, missing equipment, late return, towing or recovery charges, fuel charges, impound fees, fines, launch or dock fees, damage to trailers or accessories, and any other costs caused by Renter, Renter’s guests, operators, passengers, or invitees during the rental period.
Renter is responsible for all damage or loss occurring during the rental period, even if the amount exceeds the damage deposit. The damage deposit is not a cap on Renter’s liability.
Park City Is Rad may deduct from the deposit based on reasonable repair estimates, replacement cost, vendor invoices, photographs, inspection results, or other documentation of loss. Any unused portion of the damage deposit will be released or refunded after post-rental inspection and final calculation of charges.
Fuel terms
Fuel is not included in the rental price unless expressly stated in writing. The boat will be provided with a full tank or with the starting fuel level documented before departure.
Renter is responsible for all fuel used during the rental. If the boat is not returned with the same fuel level as provided, Park City Is Rad may charge Renter for the fuel required to restore the starting fuel level, plus a refueling service fee of $50 or 15% of the fuel cost, whichever is greater.
Fuel charges may be deducted from the damage deposit or charged to the payment method on file.
Rental fee schedule
The following charges may apply to boat rentals and may be deducted from the damage deposit or charged to the payment method on file:
- Damage deposit hold: $2,500
- Fuel: not included — refuel charge is the actual fuel cost plus a $50 service fee
- Late return: $100 per 30 minutes
- Excessive cleaning: $150 minimum
- Propeller damage: actual repair or replacement cost
- Interior / vinyl damage: actual repair or replacement cost
- Lost equipment: replacement cost
Assumption of risk
Renter understands and agrees that boating, wakesurfing, wakeboarding, tubing, swimming, loading, unloading, docking, launching, trailering, and participating in activities on or around a boat involve inherent and significant risks. These risks include, but are not limited to, collision, capsizing, falls, drowning, propeller injury, impact with the boat, dock, trailer, other vessels, submerged objects, changing weather, waves, wakes, equipment failure, operator error, passenger behavior, alcohol or drug impairment, sun exposure, cold water, fatigue, and injury or death.
Renter voluntarily assumes all known and unknown risks associated with the rental, operation, use, possession, transportation, loading, unloading, and participation in activities involving the boat and related equipment.
Renter is responsible for ensuring that all operators and passengers follow applicable boating laws, safety rules, weight limits, capacity limits, life jacket requirements, no-wake zones, lake rules, and instructions provided by Park City Is Rad.
Limitation of liability and release
To the fullest extent permitted by law, Renter releases, waives, and agrees not to sue Park City Is Rad, its owners, employees, contractors, captains, agents, affiliates, and representatives for claims, damages, injuries, losses, costs, or expenses arising out of or related to the rental, operation, use, possession, transportation, loading, unloading, or participation in activities involving the boat or related equipment, including claims based on ordinary negligence.
This release does not apply to claims that cannot legally be released under applicable law, including claims arising from gross negligence, reckless conduct, willful misconduct, or other conduct that cannot be waived by law.
To the fullest extent permitted by law, Park City Is Rad’s liability for any claim arising out of or related to the rental shall be limited to the amount paid by Renter for the rental giving rise to the claim. Park City Is Rad shall not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages.
Indemnification
Renter agrees to defend, indemnify, and hold harmless Park City Is Rad, its owners, employees, contractors, captains, agents, affiliates, and representatives from and against any claims, damages, injuries, losses, fines, penalties, attorney fees, costs, or expenses arising out of or related to: Renter’s use or operation of the boat; acts or omissions of Renter’s guests, operators, passengers, or invitees; violation of boating laws or lake rules; damage to property; injury to any person; towing, launching, docking, trailering, or transport; alcohol or drug use; or breach of this Agreement.
No minors as renters or operators
Renter must be at least 21 years old and legally authorized to operate the boat. Minors may not rent or operate the boat. Renter is responsible for all minors accompanying Renter and agrees to ensure that all minors wear required life jackets and follow all safety instructions.
Conduct
We may decline service or end a trip for unsafe, unlawful, or abusive conduct. Refunds in those cases are at the owner’s discretion.
Governing law
These terms are governed by the laws of the State of Utah.
